Somehow I missed this in the fall. Thanks for writing this.

The Cowichan decision was clearly coming in some form at some point because the courts have repeatedly said "the First Nations have constitutionally protected Title and Rights, negotiate with them. If you do not the next decision is going to be worse for the Crown" The tragetory of the court has been very clear for at least a generation.

At some point, some government in Victoria has to take the responsibility for close to 170 years of crap. But then I remember what BIll Wilson told some 30 years ago "No white government is ever going give anything to us unless we fight for it. No white government ever suffered for making the Indians looke like the bad guys." I was young nad naive at that time and thought there might grownups in power in Victoria, but no.

I am trying to tell all the enraged people I interact with that there is one solution, a negotiate settlement. There is no legal means to take Indigenous Title land from First Nations.
